This agreement is completed by the parent or legal guardian of the athlete named in this registration. In this agreement, “I” and “my” mean the parent or legal guardian signing below, and “Athlete” means the athlete named in this registration. “Released Parties” means Brickwall Softball LLC; its owners, members, instructors (including Nyree White and Mike White), coaches, staff, volunteers, and agents; and HTL Athletics, the facility’s owners and operators, and their employees and agents.

PLEASE READ CAREFULLY. THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND AN AGREEMENT TO INDEMNIFY.

1. Voluntary participation and assumption of risk

I give permission for the Athlete to take part in the clinic, including instruction, drills, demonstrations, throwing, pitching, conditioning, and related activities (“Activities”). I understand that softball and pitching instruction involve inherent risks that cannot be fully eliminated. These include being struck by thrown or batted balls or equipment; collisions; slips, trips, and falls; muscle, tendon, ligament, and joint strains, sprains, and overuse injuries; fractures; concussions; dehydration and heat-related illness; and, in rare cases, serious injury or death. I understand these risks, and I voluntarily accept them on behalf of the Athlete and myself.

2. Health and fitness

I confirm that, to my knowledge, the Athlete is physically able to take part in the Activities and has no medical condition that would make participation unsafe. I will tell Brickwall Softball in writing before the clinic about any condition, injury, allergy, or medication instructors should know about. The Athlete agrees to follow all instructions, to stop and tell an instructor if they feel pain, dizziness, or discomfort, and to stay home if they are ill.

3. Release and waiver of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, I, FOR MYSELF, THE ATHLETE, AND OUR HEIRS, EXECUTORS, AND ASSIGNS, RELEASE, WAIVE, AND DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, AND LIABILITY FOR INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO THE ATHLETE’S PARTICIPATION IN THE ACTIVITIES, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY. THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT.

4. Indemnification

TO THE FULLEST EXTENT PERMITTED BY LAW, I AGREE TO INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY CLAIMS, COSTS, AND EXPENSES, INCLUDING REASONABLE ATTORNEYS’ FEES, BROUGHT BY OR ON BEHALF OF THE ATHLETE OR ANY OTHER PERSON THAT ARISE FROM THE ATHLETE’S PARTICIPATION, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY.

5. Emergency medical authorization

If the Athlete needs medical attention and I or the emergency contacts listed in this registration cannot be reached right away, I authorize the Released Parties to arrange first aid, call emergency services, and obtain emergency medical treatment, including transport to a medical facility. I am responsible for all costs of that care. I confirm that the parent or guardian completing this registration is the Athlete’s primary emergency contact, and that the contact information I gave is accurate.

6. Photo, video, and media release

I understand that photos, video, and audio may be recorded during the clinic. I grant Brickwall Softball LLC, and those acting with its permission, the right to record, use, reproduce, edit, and publish the Athlete’s image, likeness, voice, and first name in photos, video, and audio from the clinic. This may be done in any media, including the Brickwall Softball website, social media, email, advertising, and instructional and promotional materials, without payment, notice, or approval of the final content, and without time limit. All recordings belong to Brickwall Softball LLC. If I purchase the Video Analysis add-on, I understand that the Athlete’s pitching will be recorded and reviewed for that analysis. Brickwall Softball will not publish the Athlete’s last name, school, or contact information without my separate permission.

To opt out of promotional use of the Athlete’s image, email events@brickwallsoftball.com before the clinic. Opting out does not affect registration.

7. Rules, conduct, and supervision

The Athlete will follow instructor directions and all HTL Athletics facility rules, including the footwear rule: turf or tennis shoes only, no metal cleats. Brickwall Softball may remove any athlete whose conduct is unsafe or disruptive. Brickwall Softball supervises athletes only during their scheduled session. I am responsible for the Athlete before check-in opens and after the session ends, and for picking up the Athlete on time.

8. Refunds

Registration fees are subject to the refund policy published on the clinic page. Refunds are available for a family emergency, illness, or a similar circumstance. Email events@brickwallsoftball.com to request one.

9. General terms

This agreement is governed by the laws of the State of Texas. If any part of it is found unenforceable, the rest stays in full effect, and the unenforceable part will be enforced to the greatest extent permitted. I agree that my electronic signature, my checkbox acknowledgment, and my submission of this registration have the same effect as a handwritten signature. If the Athlete is 18 years old, the Athlete also agrees to these terms.

By checking the agreement box and signing the registration form, I confirm that I am the parent or legal guardian of the Athlete, that I am at least 18 years old, that I have read and understand this entire agreement, and that I am giving up substantial rights by signing it, voluntarily and on behalf of the Athlete and myself.
